1. Acceptance of Terms
By creating an account or using ItsWhisky ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform. These terms apply to all users including bakers, vendors, and visitors.
2. Description of Service
ItsWhisky is a subscription-based platform for Caribbean home bakers. It provides tools for order management, invoicing, recipe management, client management, and marketplace access. The Platform is operated by Kaiah Digital Solutions, based in Barbados.
3. Eligibility
You must be at least 18 years of age to use the Platform. By creating an account, you confirm that all information you provide is accurate, complete, and up to date.
4. Subscription and Billing
ItsWhisky operates on a subscription model with monthly and annual billing options. Subscriptions are billed through WiPay Financial and are subject to their payment terms. Subscriptions automatically renew unless cancelled before the renewal date. Refunds are handled on a case-by-case basis — contact support within 7 days of a charge if you believe you were billed in error.
5. User Conduct
You agree not to use the Platform to post false, misleading, or fraudulent business information; harass, threaten, or harm other users; reverse engineer or attempt to copy any part of the Platform; or violate any applicable law or regulation.
6. Intellectual Property
All content created by you on ItsWhisky — including your recipes, business information, and uploaded images — remains your property. By posting content, you grant ItsWhisky a non-exclusive licence to display it within the Platform. The ItsWhisky name, logo, and platform design are the property of Kaiah Digital Solutions.
7. Limitation of Liability
ItsWhisky is provided "as is." We do not guarantee uninterrupted availability. To the fullest extent permitted by law, Kaiah Digital Solutions is not liable for indirect, incidental, or consequential damages arising from your use of the Platform.
8. Termination
We reserve the right to suspend or terminate accounts that violate these terms. You may request account deletion at any time from your Settings page. Upon deletion, your data will be permanently removed within 30 days in accordance with the Barbados Data Protection Act 2019.
9. Changes to Terms
We may update these terms from time to time. Continued use of the Platform after changes are published constitutes acceptance of the revised terms. We will notify registered users of material changes by email.
10. Governing Law
These terms are governed by the laws of Barbados. Any disputes shall be resolved in the courts of Barbados.
